Abortion clinic challenges Louisiana ‘trigger’ ban after US Supreme Court ruling – SABC News

The Louisiana Clinic on Monday filed a lawsuit challenging a law banning abortion in the Republican-led state, which took effect after the US Supreme Court’s blockbuster ruling to repeal the constitutional right to abortion nationwide.

Louisiana’s landmark 1973 Roe v. It is one of 13 states with “initiation laws” designed to ban or severely limit abortion after overturning the Wade ruling.

The Hope Medical Group for Women in Shreveport, one of Louisiana’s three abortion clinics, said in a filing in the state court that this was a testament to the state’s ability to restrict abortion after Friday’s ruling. He said he would not object.

It argued that Louisiana had no freedom to do so in a way that violated its right to due process, and that the state’s trigger ban “lacks the constitutionally required safeguards to prevent arbitrary enforcement.”

Republican Attorney General Jeff Landry did not immediately respond to a request for comment. He welcomed the Supreme Court’s decision on Friday and said at an event that those who challenge the state’s ban are “fighting a tough fight.”

The case is one of several challenging abortion laws supported by Republicans under the state constitution since the US Supreme Court ruling.

The Utah branch of Planned Parents sued the state’s trigger ban on Saturday, and abortion rights advocates plan to challenge Ohio’s abortion ban six weeks after it went into effect on Friday.

In Louisiana, Hope Medical argued that it had no way of knowing when state laws would come into force, whether one or all of them would be enforced collectively, or what exact actions are prohibited, such as where there are exceptions to save a pregnant woman’s life.

This ambiguity has led state and local officials to issue conflicting statements about whether the trigger ban is in effect, the Orleans Civil District Court lawsuit alleges.
