Some of those accused in the Mandela fraud scandal have demanded that Judge Igna Stretch dismiss herself from the case. The suspects are charged with fraud, money laundering and violation of the Municipal Finance Management Act regarding former president Nelson Mandela memorial services.
The accused – including former Buffalo City Speaker Luleka Simon-Ndzele, former Mayor Zukiswa Ncitha, and former Deputy Mayor Themba Tinta, former Eastern Cape Health MEC Sindiswa Gomba and the municipality’s former Supply Chain Manager – are consulting their legal teams on the case and will submit the reasons for the withdrawal request.

Last week, they also made representations to the director of Public Ministry to stop the case against them, due to a lack of reasonable prospects for successful prosecution. They are now represented by Legal Aid due to financial challenges.
The sitting judge is not satisfied with the delays. Judge Igna Stretch says: “The problem facing the court and it is a very real problem is the delay and the start of the trial and as indicated these proceedings can be stopped at any time, we can not expect 12 accused to sit while you come up with ideas in the middle of the night. “
The state is against these requests. NPA Regional Spokesman Luxolo Tyali says: “One of our witnesses whose schedule is very busy with all these proposals. She has been ready and on standby. You can imagine how much trouble it is for a deputy minister to appear in court every day and to hear that the matter is not being dealt with. “
The trial is scheduled to begin this month through June. The request for dismissal of the sitting judge will be processed on Friday.
