JOHANNESBURG – AfriForum’s is not convinced that Economic Freedom Fighters (EFF) leader Julius Malema and his party say they cannot pay the 500,000 rand fine the lobby group is demanding they are slapped for singing “Kill the Boer”.

The lobby group has filed a hate speech complaint against the EFF for its use of the controversial song ‘Dubul ‘Ibhunu’ – which translates to ‘shoot the boer’.

Final arguments in the case took place in the Court of Equality, sitting at the High Court in Johannesburg, on Monday.

During his remarks, the lawyer for AfriForum’s legal representative, Mark Oppenheimer, argued that it was clear that the use of the song demonstrated an intent to incite violence.

“There is no further inference to be drawn from the language and gestures used, both of which describe the use of firearms with a definite intent in mind. There is nothing ironic, poetic or ambiguous in such conduct.

And contradicting Malema’s claims on the stand that the EFF could not afford the fine AfriForum wanted, Oppenheimer pointed out that the party had previously disclosed a donation of over R3 million.

He further referenced reports that Malema had a net worth of $2 million, saying they should be investigated for perjury.

He also said that a strong message needed to be sent: “It is important to send a signal to others that this kind of speech is not protected speech, that there will be consequences, that one cannot not just apologizing for it – especially under conditions where the EFF has been completely and utterly unapologetic about it.
