Former President Jacob Zuma says attempts to get him back in prison are doomed to failure due to misinterpretation of the law.
Zuma and the police have succeeded present their reasoning at the right time in the Supreme Court (SCA) in Bloemfontein.
They have appealed to the Supreme Court of Norður-Gauteng, which ruled that his release on probation was illegal and irrational.
Zuma was sentenced to 15 months in prison of the Constitutional Court for contempt of court, after he violated his previous order to obey the Citizenship Committee’s summons to appear before it.
In the papers for SCA, Zuma says that the respondents, the Democratic Alliance (DA) and the Helen Suzman Foundation (HSF) have deliberately approached the issue on the wrong grounds.
Lawyer Lebohang Mokhele has weighed in.
“From the ruling of the Supreme Court, I do not see that the appeal will succeed. I think the Supreme Court only allowed him to appeal in order for them to enjoy certainty and finality in the case. Because you will also remember that one of the reasons that the former sheriff mr [Arthur] Fraser said he had given Zuma a medical certificate to avoid the riots that were taking place in Durban.
