Prime Minister of the Eastern Cape, Oscar MabuyaneHas filed a motion notice with the Bisho High Court to the Priority Criminal Investigation Bureau, Hawks, and Police Minister.
The proceedings were filed following Hawks’ investigation into the Prime Minister of the Eastern Cape.
Mabuyane wants the court to rule that Hawks refuses to provide information in the investigation file, reserves it, suspends the investigation into him, and declares it illegal and unconstitutional.
Mabuyane wants to hear his application in court on October 19th if no notice of intent to oppose is submitted.
Mabuyane has written supporting documents that question the jurisdiction of Hawks’ Free State Division investigating the Eastern Cape-based case and believes that there is political motive behind the investigation.
Ngqiqo Sakhela, Mabuyane’s legal representative, states that Mabuyane is exercising constitutional rights and that the Hawks must provide the information he requires in accordance with an agreement between them.
“In the light of the ANC resolution, there is a problem with this situation as a whole. If you are prosecuted, you have to leave, there is a great deal of prejudice. You are a suspect and your constitution If your rights are suppressed, you must go to court to prove your rights. “
