Public sector unions have lost their constitutional court motion to force the government to honor the 2018 three-year wage agreement. The Constitutional Court dismissed the unions’ appeal.

This came after the government conquered some aspects of its collective wage agreement, citing lower tax revenues. The salary increase would have contributed Rs 38 billion to the already high wage costs in the public sector.

The Constitutional Court has dismissed the public sector union’s appeal against the 2020 Labor Court of Appeal ruling. In that judgment, the Labor Court of Appeal rejected Article 3.3 of the Trade Union Collective Agreement. request for the implementation of That clause set out the wage increases in the public sector for the financial year 2020/21.

SAFTU secretary general Zwelinzima Vavi says they are disappointed with the court’s decision.

“It has been decided that, given the difficulties faced by the capitalist layer in 2008/2009, which has now been exacerbated by the coronavirus, workers will have to pay and bear the consequences. The Constitutional Court has ignored all our arguments that South Africa does not need a debt crisis and South Africa a fiscal crisis. It is a political decision by the government facing the fiscal crisis that resources are available through taxation and wealth and solidarity in this country; all this was ignored by the court. In his budget speech last week, Finance Minister Enoch Godongwana announced a marginal increase in public funds of 1.8% in the current fiscal year. He also expressed concern about rising debt levels, which pose a risk to the budget.

The minister is expected to meet with unions next month to address the issue of public sector wage costs.
